GENERAL INFORMATION, RIGHTS RESERVED AND LIMITS OF RESPONSIBILITY
SELECTOURS TRAVEL is acting as a charter agent for tours and cruises. The tour, air and/or the cruise companies are the sole operators of the tour or cruise. All participants are required to sign the “Tour Participant Agreement” prior to departure of the tour or cruise. Air passengers are governed by the International Air Transports’ International agreements. Cruise passengers are governed by the International Terms and Conditions of Passage. Land arrangements are governed by the local governmental laws and regulations. SELECTOURS accepts no responsibility beyond the level of being the charter agent. Every passenger is required to purchase a ticket for passage on the tour, airline or cruise. Your ticket purchase constitutes a contract between the operating company and yourself. Your acceptance or use of the ticket, or payment of deposit or full fare, constitutes agreement to the terms and conditions of passage which include limitations of your rights. Your should read and understand the Terms and Conditions of Passage carefully before making a deposit or accepting the ticket. The terms “you” and “passenger” refer to the person(s) named on the confirmation/ ticket. The term “carrier” includes all airlines, cruise companies, tour operators, ground operators and hotels and their owners and agents.
INFORMATION SUBJECT TO CHANGE
All prices quoted in the trip brochure are based on the rates of currency exchange and costs as of the publication date of the trip brochures and are subject to change after that date. While every effort will be made to adhere to the specifics in this and any other brochure, publication or advertisement, certain circumstances may necessitate alterations; therefore, all fares, taxes, schedules, ports of call, hours of arrival and departure, tour schedules, aircraft times, and all other information are subject to change without notice. Reservations are confirmed with the passenger list of accommodations and fares. Verbal quotations will not be honored.
FARES, TAXES, PORT CHARGES, AND RATES
All fares quoted are in US dollars. Fares include the products and services listed for each departure. Fares quoted are based upon per person double/twin occupancy. Single supplements are available at 150% of the per person/double occupancy price unless otherwise quoted in the details of a given departure. Single shares may be available on selected departures. Consult individual departure brochures for specific inclusions. Some sports equipment and professionals, such as supervised SCUBA, may require additional fees. Port charges, taxes, airport facility charges, optional tours, land programs, travel insurance, and other products may require additional payments and are solely the responsibility of the passenger. Personal charges, some specialty liquors, gift-shop purchases, medical services, phone calls, video rentals and any and all items deemed as a personal need are the sole responsibility of the individual passenger. Carriers may, upon prior notification, require additional deposits from passengers for special requests or products.
DEPOSITS AND PAYMENTS
For confirmation of individual reservations, a non-refundable deposit is due within seven days of reservation. Failure to pay deposit in a timely manner can result in the cancellation of the reservation. The payment schedule for the balance of the booking is detailed on the applicable tour brochure. If a credit card is presented for the initial deposit, the same credit card may be processed for remaining payments per the payment schedule. Reservations received within payment schedules will require payments due at the time of reservation. SELECTOURS accepts personal checks, cashiers’ checks, agency checks, VISA and MASTERCARD (for deposits only). All funds must be in US dollars. No personal or agency checks will be accepted less than 30 days prior to departure date.
CANCELLATIONS, REFUNDS AND CHANGES
Cancelled bookings are subject to the following conditions: a) the initial deposit is non- refundable upon receipt of payment; b) there will be a $50 processing fee deducted from all cancellation refunds; c) cancellations received more than 149 days prior to departure will receive a 50% of payments made refund; d) cancellations received between 149 days prior and 121 days prior will receive a 25% of payments made refund; e) cancellations received less than 120 days prior to departure will receive no refund. Some brochures have different refund schedules and will be used instead of the terms shown above. Name changes will be accepted up to 60 days prior to departure with a fee charged of $75.00 for processing. Name changes less than 60 days prior to departure will be at the discretion of the tour operator. Changes and cancellations must be received in writing. .A passenger failing to make a departure will be considered a “no-show” and no payments are refundable. WE HIGHLY RECOMMEND YOU PURCHASE TRIP CANCELLATION AND INTERRUPTION INSURANCE. The tour
Operator is not responsible to make refunds other than those specifically mentioned in the tour brochure. Insurance is available from SELECTOURS, local travel agencies and some retail insurance offices. Trip cancellation and interruption insurance is non- refundable. Trip cancellation and interruption insurance does not cover administrative fees assessed by the tour operators.
MEDICAL ATTENTION AND PHYSICAL DISABILITY
SELECTOURS reserves the right to refuse or revoke passage to anyone which is, in the sole judgment of the tour operator or carrier, in a physical or mental condition as to be incapable of participating in the tour, cruise or package, or who may require care beyond that which the tour operator or carrier can provide. Only limited medical facilities and treatment are available onboard ships. Carriers are not responsible for medical care. Prescription medicines are the sole responsibility of the passenger. Refrigeration may or may not be available at all times on all itineraries. Certain safety regulations may cause minor difficulty for the mobility impaired. Passengers with physical limitations are advised to check on facilities for each departure prior to booking. The charter operator and carriers cannot provide special assistance. Special transfer arrangements may need to be made by the passenger at their expense. WE HIGHLY RECOMMEND TRAVEL INSURANCE FOR MEDICAL EXPENSES. Additionally, any
medical condition or physical limitations that may require special attention or treatment must be advised to the tour operator at the time of booking. It is recommended that
physically challenged persons travel with someone who is able to assist them in their travel needs. And, these passengers cannot participate in the single share programs of the tour operator or the carriers.
BAGGAGE
All bags must be securely packed and labeled with the passenger’s complete name as it appears on the passport, the tour or ship name, cabin or room number, and date of departure. Valuables, breakable items and hand luggage should be carried personally. The tour operator and carriers are not responsible for any loss, theft or damage to passenger’s baggage or personal property. Any liability for loss or damage to baggage or personal property is limited to the terms and conditions specified and any tickets or documents of passage. WE HIGHLY RECOMMEND TRAVEL INSURANCE TO COVER BAGGAGE AND TRAVEL DOCUMENTS.
ATTIRE
The tours and cruises arranged by the tour operator, SELECTOURS, are uniquely and specifically designed for maximum enjoyment. Passengers are required to wear appropriate travel clothing in aircraft, ports, during land tours, during most meal functions, and where otherwise instructed by the tour escort, captain or other officer of the charter tour operator and the carriers.
ASSUMPTION OF RISK
I hereby acknowledge that during the trip that I will be participating in under the arrangement of SELECTOURS, it’s officers, agents, servants, employees and associates certain risks and dangers, inherent or otherwise, may occur, including, but not limited to, the hazards of traveling unfamiliar or underdeveloped areas, accident or illness in remote places without medical facilities, the forces of nature, guerrilla or terrorist warfare, states of siege, and travel by air, train, automobile, 4WD, boat, ship or other conveyance. In consideration of, and as part payment for the right to participate in such trips or other activities and the service and food arranged for me by SELECTOURS, I have and do hereby assume all of the above risks and will hold SELECTOURS harmless from any and all liability, action, causes of action, debts, claims, demands, judgments’, executions, costs, loss of services, expenses, compensation and any and all other claims of damages whatsoever, both in law and in equity, which I may have against SELECTOURS and/or the various trip operators of any kind and nature whatsoever whether connected with hotel accommodations, any acts or omissions of SELECTOURS, the various trip operators or any other person, any form of transportation or any other facet of the trip which I now have or which may arise from or in connection with my trip or participation in other activities arranged for by SELECTOURS. The terms and conditions contained herein and those printed on the applicable travel brochure, which I acknowledge having read and understood, shall serve as a waiver of liability of SELECTOURS, and the various trip operators and an assumption of risk on behalf of myself, my heirs, executors, administrators, successors and assigns for any and all known and unknown person injuries, emotional trauma, conscious suffering, death and/or property damage or loss.
OTHER INFORMATION
No visitors will be allowed at any point of embarkation without the prior approval of the tour operator or carriers. At no time will any pets be allowed on any tour or cruise arranged by SELECTOURS. The tour operator and/or carriers are not responsible for any individual charges by a passenger for a product or service not covered in the “inclusion” section of the brochure for any given departure. Additionally, in the case of sailing vessels; due to the type and nature of the vessel departure/arrival times, anchor locations, and other associated limitations are at the discretion of prevailing winds, tides and weather conditions. At all times, participants are required to carry a valid passport. All passengers are solely responsible for visa and entry requirements of given countries and municipalities. Booking agents will advise, at time of booking and to the best of their knowledge, visa requirements.
CANCELLATION, DELAY OR DEVIATIONS OF DEPARTURE
The tour operator and/or carriers may at any time, without notice, substitute vessels, delay or cancel the departure, change the departure date or time; and the passenger shall have no claim against the tour operator and/or carriers for resulting hotel, food, travel or other expenses, delay or inconvenience whatsoever, other than reimbursement of the unearned tour or cruise fare for the cancelled tour or cruise. If, after departure, the tour or cruise is interrupted by a fortuitous event, Act of God or any other cause for which neither the tour operator, carrier nor passenger is responsible. Or if the tour or ship is or will be unduly delayed or prevented from proceeding in the ordinary course; the tour operator and/or carrier shall have the right to terminate the tour or cruise at its option based on the safety of the passenger, crew, vessel or value thereof. Passengers will be refunded unearned portions of the tour or cruise upon recovery of funds or a substitute carrier may be engaged to fulfill the balance of the tour or cruise. In all such cases, unless otherwise stated herein, the passenger shall not be entitled to any compensation of any kind and shall have no other claim against the tour operator or carriers. In all situations the tour or ship shall have liberty to proceed without pilots, to tow and assist, and to deviate from the advertised routings and to call or omit to call at any port or place for any reason or purpose which in its judgment is reasonable under the circumstances then existing, and to comply with all orders given by governmental authorities, the underwriters or the carriers. The passenger shall have no claim whatsoever against the tour operator or carriers in such circumstances.
INDEPENDENT CONTRACTOR / LIMIT OF LIABILITY
SELECTOURS’ liability and responsibility extends only to the reservation and collection of fares. Carriers’ liability and responsibility does not extend beyond the vessel or transport as defined. SELECTOURS does not own or control any airline, ground operator, hotel, ship line, or transportation company. As a convenience to passengers, SELECTOURS acts as a booking agent and may sell tickets for or arrange other services. SELECTOURS accepts no responsibility in any way for any damage, loss, injury or death arising in conjunction with the service provided by these independent contractors.
